Background of the Study
Judicial review is a fundamental principle of constitutional law that ensures that executive actions comply with legal and constitutional provisions. It serves as a mechanism for maintaining checks and balances, preventing the abuse of power by the executive arm of government. In Nigeria, the 1999 Constitution vests the judiciary with the authority to review executive actions, decisions, and policies to ensure they conform to constitutional principles (Adebayo & Yusuf, 2024). However, in many cases, the judiciary faces obstacles such as executive interference, political influence, and limited judicial independence, which undermine the effectiveness of judicial review (Okeke, 2023).
In Zaria Local Government Area, Kaduna State, issues surrounding the enforcement of judicial review mechanisms have become increasingly significant. Cases of executive overreach, administrative misconduct, and lack of accountability often emerge at the local government level, yet the judiciary’s role in reviewing these actions remains contested. Judicial review is intended to ensure that executive authorities do not exceed their constitutional limits, but in practice, courts sometimes struggle to enforce their rulings due to institutional weaknesses and political pressures (Abubakar & Ibrahim, 2023).
This study investigates the impact of constitutional law on the judicial review of executive actions within Zaria Local Government Area, assessing how effectively the judiciary holds the executive accountable. The study also explores the challenges and limitations of judicial review and proposes solutions for strengthening constitutional mechanisms to enhance good governance and the rule of law.
1.2 Statement of the Problem
Although the 1999 Nigerian Constitution grants the judiciary the authority to review executive actions, the practical enforcement of judicial review remains weak, particularly at the local government level. In Zaria Local Government Area, instances of executive overreach, policy inconsistencies, and violations of constitutional provisions often go unchallenged due to limitations in judicial enforcement mechanisms (Aliyu, 2024). The inability of courts to effectively review and overturn unlawful executive actions raises concerns about the effectiveness of constitutional law in safeguarding democracy and the rule of law. This study seeks to examine the role of judicial review in ensuring executive accountability in Zaria LGA and to propose strategies for enhancing the judiciary’s oversight role.

1.5 Research Hypotheses
H₀: Constitutional law does not significantly influence judicial review of executive actions in Zaria LGA.
H₁: Judicial constraints limit the effectiveness of executive accountability in Zaria LGA.
H₂: Strengthening judicial independence and constitutional enforcement will enhance executive accountability in Zaria LGA.
1.6 Significance of the Study
This study is significant as it highlights the role of constitutional law in ensuring executive accountability through judicial review. By examining the legal challenges that hinder effective judicial oversight, the study contributes to discussions on judicial independence, good governance, and democratic accountability. Policymakers, legal practitioners, and scholars will find the study valuable in formulating legal reforms that enhance the judiciary’s role in executive oversight.
Additionally, the study will provide empirical insights into how constitutional law is implemented at the local government level, offering recommendations for improving the judicial review process in Zaria LGA and beyond.
1.7 Scope and Limitations of the Study
This study focuses specifically on Zaria Local Government Area, Kaduna State, and examines how constitutional law influences judicial review of executive actions within the LGA. It does not extend to state or national levels but focuses on local governance.
